Right of withdrawal
Pursuant to the "Consumer Code" you have the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty.
Pursuant to art. 52 of the Consumer Code, the Consumer may withdraw from the contract within 14 days from receipt of the goods or, in the case of delivery of a good consisting of multiple lots or pieces, from the day on which the Consumer or a third party, other than the carrier and designated by the Consumer, acquires physical possession of the last lot or pieces.
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by means of an explicit declaration, for example a letter sent by post, fax or e-mail.

To meet the withdrawal deadline, it is sufficient for you to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
To exercise the right of withdrawal:
1. Send an email containing the order number and the reason for withdrawing, you can also withdraw without justifying the reason

The right of withdrawal is however subject to the following conditions:
1. The law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product.
2. By law, the shipping costs for returning the goods are charged to the customer.
3. The shipment, until the certificate of receipt in our warehouse is under the complete responsibility of the customer.
4. IMC Solutions is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments.
5. In case of damage to the goods during transport, IMC Solutions will notify the customer of the incident (within 5 working days from receipt of the goods in its warehouses), to allow him to file a complaint against the courier he has chosen and obtain the reimbursement of the value of the asset (if insured). In this case, the product will be made available to the customer for its return at the same time as canceling the request for withdrawal.
The right of withdrawal is totally lost, due to lack of the essential integrity of the goods (packaging and / or its contents), in cases where IMC Solutions ascertains:
to. The lack of the external packaging and / or the wrapping containing the purchased product (e.g. Pasta, Biscuits, etc.)
b. Damage to the product for reasons other than its transport.
In case of forfeiture of the right of withdrawal, IMC Solutions will return the purchased good to the sender, charging the shipping costs to the sender.
Effects of withdrawal
If you withdraw from this contract, you will be reimbursed for all payments you have made to us, including delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery to offered us), without undue delay and in any case no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. The refund may be withheld beyond 14 days only until you have demonstrated that you have returned the goods or until we have received them, whichever occurs first.
These refunds will be made using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise; in any case, he will not have to incur any costs as a consequence of this reimbursement. The reimbursement may be suspended until the goods are received or until the consumer demonstrates that he has returned the goods, whichever is earlier.
You are only responsible for the decrease in the value of the goods resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.
Please return the goods or deliver them to us without undue delay and in any case within 14 days from the day on which you have notified us of your withdrawal from this contract. The deadline is met if you send back the goods before the 14-day period has expired.

Exclusions from the right of withdrawal
The right of withdrawal is excluded in the following cases provided for by Article 59 of the Consumer Code:
a) service contracts after the complete provision of the service if the execution began with the express agreement of the consumer and with the acceptance of the loss of the right of withdrawal following the full execution of the contract by the professional;
b) the supply of goods or services whose price is linked to fluctuations in the financial market that the trader is unable to control and which may occur during the withdrawal period;
c) the supply of goods made to measure or clearly personalized;
d) the supply of goods which risk deteriorating or expiring rapidly;
e) the supply of sealed goods which cannot be returned for hygienic reasons or related to health protection and have been opened after delivery;
f) the supply of goods which, after delivery, are, by their nature, inseparably mixed with other goods;
g) the supply of alcoholic beverages, the price of which has been agreed upon at the time of the conclusion of the sales contract, whose delivery can only take place after thirty days and whose actual value depends on fluctuations on the market that cannot be controlled by the professional;
h) contracts in which the consumer has specifically requested a visit by the professional for the purpose of carrying out urgent repair or maintenance work. If, on the occasion of this visit, the trader provides services in addition to those specifically requested by the consumer or goods other than spare parts necessary to carry out maintenance or repairs, the right of withdrawal applies to such additional services or goods;
i) the supply of sealed audio or video recordings or sealed computer software which have been unsealed after delivery;
j) the supply of newspapers, periodicals and magazines with the exception of subscription contracts for the supply of such publications;
k) contracts concluded at a public auction;
l) the provision of accommodation for non-residential purposes, the transport of goods, car rental services, catering services or services relating to leisure activities if the contract provides for a specific date or period of performance;
m) the supply of digital content by means of a non-material support if the execution has begun with the express agreement of the consumer and with his acceptance of the fact that in this case he would have lost the right of withdrawal.
